Question: Recently requested a premediation meeting with condo board and their lawyer to try and resolve issues surrounding putting up a fence around our exclusive use condo backyard. Attended meeting and corporate lawyer said he was unsure if the meeting qualified as a premediation meeting and wanted our session to constitute an informal get together. I’m suspicious as to why? can you help?
Answer: A meeting before mediation is a good idea but it is not required and has no official status whether you call it an informal get together or premediation. Mediation is a process recognized under the Condominium Act and requires a mediator to be present and presiding over it.
